Computers Terms and Conditions

Please read these terms and conditions carefully.  They set out the agreement between you and us with respect to your purchase.  By proceeding and completing an application and/or purchasing a product from us, you are agreeing to these terms and conditions.

EZCREDITWAREHOUSE.COM is owned and operated by IAM Financial Services, a division of IAM Technologies Inc.  All references below to Ezcreditwarehouse.com are implied to also include IAM Technologies Inc.

Returns and Exchanges: In the event of an exchange or a return, the merchandise would need to be returned in the original package. The shipping and processing fee of 30% (or $20.00 minimum) is not available for refund or credit.

•  Electrical parts are non-refundable/ returnable if ordered incorrectly by the customer.

•  For information regarding returns and exchanges, please refer to your specific Warranty.

Return Material Authorization Numbers

•  Customer must obtain a valid authorization number to indicate the return has been authorized by     
    calling Customer Service at 866-300-2070. That authorization number must be clearly marked on
    the bottom of the package.

•  The customer prepays all freight charges on items being returned that they have ordered incorrectly.

•  Packages received without an authorization number will be returned to the customer at the
   customer’s expense. All matters must be resolved within 30 days.

•  IAMFS is responsible only for merchandise purchased directly from IAMFS Inc.

Returns:

•  The customer would be responsible for freight both from and to IAMFS.

•  Items beyond 1 (one) month from date of shipment are not eligible for return.

•  All authorized items (excluding damaged items) being returned must be in resalable condition.

•  IAMFS will make the determination for return after evaluating the returned product. If the product
   needs to be returned to the customer, it will be at the customer’s expense.

•  IAMFS may refuse credit for:

1. Improper installation

2. Failure to provide suitable operating conditions

3. Use of product for which it was not designed

4. Alteration or modification of any part

5. Abuse, misuse or neglect

Cancellations:

•  If the order has not shipped, the customer shall be responsible for a processing fee of 20%

•  If the order has been shipped, the customer will be responsible for the freight both from or to the
   customer and from or to IAMFS and a processing fee of 30% (or $20.00 minimum).

Freight Claims and Shipment Damage:

•  If a damaged package is received, the customer must notify Customer Service immediately on
   receipt of the package.

Thank you for your purchase of an Acer Advantage warranty extension or upgrade. Acer America Corporation ("Acer") is proud to offer our customers reliable and cost-effective service contracts to enable you to extend your limited warranty. Our Acer Advantage Service Plan Administrators are committed to providing you with dependable, steadfast service throughout your Extended Service Plan coverage period. YOUR ACCEPTANCEBy purchasing this warranty extension or upgrade you agree to the terms and conditions of this Extended Service Plan. SERVICETo contact Acer for service under this Plan within the U.S. or Canada, please call Acer's Customer Service at (800) 816-2237. An Acer technician may be able to resolve the issue over the phone or by shipping a user-replaceable part to your location. If telephone consultation cannot resolve the issue, the Acer technician will recommend the best course of action for timely repair of your system. REGISTRATIONIn the purchase of this warranty extension or upgrade your computer has automatically been registered in Acer's Customer Service System. If, for some reason, you computer should need service this will help expedite that process. TERMS OF AGREEMENTGENERAL UNDERSTANDINGThis Extended Service Plan (the "Agreement") is entered into by Acer America Corporation ("Acer") and the end user (the "Customer"), who is the original purchaser of the Acer computer hardware ( the "Equipment"), for which the Customer has ordered this Agreement. Acer shall perform hardware maintenance service only on the Equipment for which this agreement was purchased, for the Customer who originally purchased the Equipment. This Agreement is not assignable to subsequent owners of the Equipment. Upon receipt and acceptance by Acer of this Agreement from the Customer, Acer agrees to service and provide all parts and labor necessary to repair your Acer computer to its proper operating condition consistent with Acer product specifications. Acer has the option to repair or replace parts or the entire unit. Replacements will be provided to the Customer - at Acer's sole discretion - on an exchange basis only. These replacement parts or units will have a value that does not exceed the fair market value of the exchanged unit. At Acer's discretion, replacement parts or units will be either new or refurbished like new parts or units. All removed parts or units become Acer property, and Acer shall have no obligation to return said parts. Acer reserves the right to terminate this Agreement or refuse service when, in Acer's opinion, unit conditions represent a hazard to the safety or health of any service provider. All interconnecting cords and cables on the Equipment to be serviced must be properly attached to the Equipment. SERVICE PROVIDEDAcer agrees to provide service during Acer's basic service availability period, which is 8:00 a.m. to 5:30 p.m. (CST), Monday through Friday, excluding Acer holidays. The Customer shall make the initial service request to Acer Customer Service at (800) 816-2237. If it is determined that a repair is required, the Customer will receive instructions on returning the Equipment to Acer. The Customer shall pay incoming freight charges, and the Customer remains responsible for any loss or damage to the Equipment. Upon completion of the repair, Acer shall return the Equipment to the Customer, freight prepaid. SERVICES NOT COVEREDThe following services are not covered under this Agreement. However, if requested by the Customer, the repair or replacement of the Equipment requiring service under these conditions may be performed by Acer at the then current terms, conditions, and rates for such service and as agreed to by Acer.

  1. Installation, deinstallation, engineering and/or configuration changes, packing and shipping, and relocation of Equipment.

  2. Services for accessories, attachments, or other devices used with the Equipment, including but not limited to electrical work, external interconnecting cords and cables, batteries, AC adapters, and plastics.

  3. Repair to Equipment due to installation or servicing by an unauthorized party.

  4. Repair or replacement of Equipment necessitated by fire, water, other causality, acts of God, Customer's misuse, negligence, alteration, improper environment (including lack of proper temperature or humidity), unusual physical or electrical stress or interference, failure or fluctuation of electrical power, improper movement, or acts of an unauthorized party.

  5. Inspection and testing by Acer resulting in "no problem found" will result in a separate charge to Customer.

  6. Service necessary to comply with requirements or regulations of any government body or agency arising after the date of order confirmation; or if the serial numbers of the Equipment have been tampered with or removed.

  7. Recovery or replacement of any data or software stored on the Equipment.

  8. Upgrades or preventative maintenance of systems.

  9. Repair of Equipment not purchased from Acer America Corporation or an Acer America Corporation Authorized Reseller.

  10. Repair of Equipment not purchased in the U.S., Canada, or Puerto Rico.

  11. Repair, damage, or loss of anyremovable storage media.

LIMITATIONS OF SERVICE

Equipment is priced and supported under this Agreement using the original operating system software, as pre-loaded by Acer at the time of system purchase. If the aforementioned operating system software is altered or upgraded by the Customer or the Customer's agent, Acer may request the removal of such operating system software and the restoration of the original operating system software in order to troubleshoot any technical problems that may arise during the term of this Agreement.

TERM

The effective date of your service coverage will be the date of purchase of the AcerAdvantage Extended Service Plan. This date is shown at the top of this document. Beginning on the effective date of this Agreement, this Agreement shall continue for the term which is also shown on the top of this document.

TERMINATION; CANCELLATION

If there is a failure by one of the parties here to comply with the terms and conditions of this Agreement, both during and after the initial term, the other party may terminate this Agreement by providing the non-complying party within (30) days prior written notice. Acer may cancel this Agreement if Customer does not pay according to the terms of the service invoice, breaches any term of this Agreement, sells the Equipment to another party, substantially alters the Equipment from its original condition, becomes insolvent, or makes an assignment of property for the benefit of creditors. Customer may cancel this Agreement in writing within the first thirty (30) days of Customer's receipt of the Extended Service Plan Certificate, and obtain a full refund of original purchase price as long as no claims have been made against this Agreement. If Customer makes claim against this Agreement within thirty (30) days of receipt of the Extended Service Plan Certificate, Acer will offer a pro rated refund based on the elapsed time of this Agreement or retail value of any service performed up to the date of the written cancellation.

LIMITATION OF LIABILITY

THE CUSTOMER AGREES THAT ACER'S TOTAL LIABILITY HEREUNDER INCLUDING, BUT NOT LIMITED TO, ANY ALLEGED NEGLIGENCE OF ACER SHALL NOT EXCEED THE AMOUNT PAID FOR MAINTENANCE SERVICE UNDER THIS AGREEMENT ATTRIBUTABLE TO THE PARTICULAR UNIT OF EQUIPMENT DIRECTLY INVOLVED. IN NO EVENT SHALL ACER BE LIABLE TO THE CUSTOMER OR ANY OTHER PERSON OR ENTITY FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR SPECIAL DAMAGES OF ANY NATURE, INCLUDING WITHOUT LIMITATION, LOSS OF DATA OR BUSINESS PROFITS, ARISING FROM ACER'S PERFORMANCE OR NONPERFORMANCE OF THIS AGREEMENT.

This limitation applies whether damages are sought, or a claim made, under this Agreement or as tort claim (including negligence and strict product liability), contract claim, or any other claim. This limitation cannot be waived or amended by any person. This limitation of liability will be effective even if Acer or an authorized representative of Acer has been advised by you of the possibility of such damages.

FORCE MAJEURE

Acer shall not be liable to the Customer for any delay or failure by Acer to perform its obligations under this Agreement or otherwise if such delay or failure arises from any causes beyond the reasonable control of Acer.

MISCELLANEOUS

  1. This Agreement is valid only in the United States (fifty states and District of Columbia), Canada, or Puerto Rico (service in Puerto Rico subject to restrictions, please call (800) 816-2237 for further information). An Acer Extended Service Plan may be purchased only through a participating Acer Authorized Reseller or directly from Acer's Extended Service Department. The terms and conditions of this Agreement shall prevail over any conflicting, additional inconsistent provisions, any purchase order, or other document that may be submitted by the Customer. This Agreement is the complete agreement between parties and supersedes all previous agreements, written or oral, with respect to the subject matter of this Agreement This Agreement may not be amended, and none of its provisions may be waived, except in writing by a duly authorized representative of the party against whom such amendment or waiver is sought to be enforced. This Agreement is governed exclusively by the laws of the State of California as such laws are applied to agreements between residents entered into and performed in the State of California. Any legal action related to this Agreement shall be instituted only in a State or Federal court located in Santa Clara County, State of California, and the parties consent to such choice of forum.

    No action which arises out of this Agreement may be brought by either party more than two (2) years after the cause of action has arisen, except that action for non-payment be brought within four (4) years from the date the cause of action arose.

  2. This Extended Service Plan will be entered into by Acer America Corporation, a California corporation, with a principal place of business at 2641 Orchard Parkway, San Jose, CA 95134 when Customer is sent an Extended Service Plan certificate.

OBTAINING REPAIR SERVICE

If you purchased an AcerAdvantage Extended Service Plan and are located in the Continental United States (fifty (50) states and the District of Columbia), Canada, or Puerto Rico (service in Puerto Rico subject to restrictions, please call (800) 816-2237 for further information), you are entitled to repair service during the term of this Agreement subject to the following terms and conditions:

  1. Before calling Acer Technical Support, please run the Hardware Diagnostics. This will help us provide you with better quality support. Please refer to your User's Guide for instruction.

  2. Acer will attempt to resolve warranty issues over the telephone. If telephone resolution is not possible, Acer will require your assistance in performing routine diagnostic procedures. Acer will then issue you a Return Materials Authorization (RMA) number to be used as a means of identifying the equipment returned.

  3. Repair service must take place by returning the equipment to an Acer authorized location as identified by Acer personnel at the time the RMA number is issued. You must prepay any shipping charges, export taxes, custom duties and taxes or any other charges associated with transportation of the equipment. In addition, you are responsible for insuring any equipment shipped or returned. You assume the risk of loss during shipment.

  4. Use the original shipping and packing materials and include a description of the Product symptom. The Return Materials Authorization (RMA) Number must be placed on the exterior shipping container. You must provide Acer or an Acer Authorized Service Provider with proof of purchase prior to the time of repair.

Product Questions The best way to contact us about our products is email.  Provide product numbers and any questions you have.  Email questions to: info@ezcreditwarehouse.com.   Emails will be answered in the order they are received.  You can also call our office at 1-866-300-2070 from 9 am to 8pm Monday - Friday (Eastern Standard Time).

Order Status:  Check the status of your order at orderStatus@ezcreditwarehouse.com.  Please provide the full billing name, the date ordered and the order number.

Payment:  In addition to our very liberal credit financing, we accept Visa, MasterCard, Money Orders, Cashiers Checks and personal checks.  Your credit card will be charged 12-24 hours after you place your order.  We have a "Pre-pay" policy to protect ourselves from fraudulent orders.  We also accept checks by fax.  Just fax a copy to 812-944-4953 and our billing department will contact you to verify the info and your order before processing your check.  We do not accept any other forms of payment, and do not offer C.O.D. terms. 

Sales Tax:  There is no sales tax charged unless you live in the State of Indiana.  Indiana State sales tax is 6.5%.

Shipping and Delivery Ezcreditwarehouse.com ships anywhere in the continental United States only. Due to extremely high shipping cost we do NOT ship to Hawaii and Alaska. We do not ship to APO or FPO addresses

Shipping Dates Our goal is to quickly ship your product.  We will make every effort to deliver in 3-4 weeks.  You may contact us about order status at any time.  We will provide you the shipper’s tracking number, phone number and website to monitor your order.  In some cases, due to demand of an individual item, shipping time may take up to 4-6 weeks.  We do not partial ship.  All items must be shipped at the same time.  

 Please Note: The shipping times we quote are estimates, not guarantees.  When it comes to order times we are depending on the factory to provide us with the estimated ship date.  If we find that there's going to be an unusual delay for your order, we will notify you.

The shipping company will contact you at least 1 day in advance to arrange a time for delivery that is acceptable to both parties.

Out of Stock/Backorder Products:  In some cases, items will be backordered or out of stock. You will be notified with estimated delivery time.  We cannot give out exact delivery dates since we are waiting for these products from the factories. In some cases, this can take up to 8 weeks. In this instance you will be given the opportunity to modify your order to a product in stock.

Transit Time: On average, most large items take 3 to 10 days in transit from the time it ships, not from the time it’s ordered.  Most deliveries are made Monday thru Friday.  We cannot give out exact delivery dates.  We can only tell you when your bed will or has been shipped.  The delivery service will contact you to give you your exact delivery date and time.

Delivery Acceptance and Inspection:  Drivers cannot deliver furniture if someone 18 years or older is not at home at the time of delivery.  Drivers cannot handle furnishings that are not listed on the delivery documents. 

You must inspect your order upon arrival and notify the carrier of any damage incurred during shipping, as well as of any defects in manufacturing that can be observed upon reasonable inspection.  Note any problems in writing on the bill of lading before the driver leaves.  UNLESS AN ISSUE IS NOTED IN THIS WAY, YOU WILL BE DEEMED TO HAVE ACCEPTED THE GOODS IN THE CONDITION DELIVERED.  

All goods are professionally packed by the manufacturer for shipping, but damage during shipment can sometimes still occur.  Shipping damage is the responsibility of the carrier, and any manufacturing defects are the responsibility of the manufacturer.  Neither is a likely occurrence, but we will assist you in resolving such issues in any way we can, so long as they are recorded by you at the time of delivery as described above.  In many cases, damage or defects can be corrected on site, eliminating the need to re-pack and return the goods.  If not, the carrier will be responsible for returning the item, and it will either be repaired or replaced and will be re-delivered at no additional expense to you.

Damaged Items:  All products are fully inspected and are in perfect condition before being shipped out.  When the merchandise is received, we ask that you inspect the outside of the cartons for any shipping damage. In the event there is noticeable damage to the cartons or packaging, we ask that this be noted on the freight bill as “Damaged Cartons. Subject to inspection”.  Do not send back the merchandise.  If you find there is damage to the product, contact us within 24 hours of receiving and we will either repair or replace the merchandise.

For missing parts, etc., please contact us by phone or email within 7 days of receipt for replacement parts.

Pricing:  If there is a pricing error on our web site, we will contact you with the correct price before processing your order.  Prices are subject to change at any time.

Discontinued Items:  On occasion, items will be discontinued without notice.  In this case we will contact you with a replacement or similar product.  At this time the order can be canceled without penalty.

Integration These Terms of Sale constitute the entire agreement between you and us regarding your order, and supersede and replace any prior or contemporaneous understandings, representations or agreements, written or oral.  If any part of these Terms of Sale is found void or unenforceable, it will not affect the validity of the remaining Terms of Sale, which will remain valid and enforceable.  Any waiver of any provision of these Terms of Sale will be effective only if in writing and signed by an officer of IAM Technologies Inc.
